PROGRAM REQUIREMENTS
H-2A employers are responsible for providing, paying or reimbursing travel costs for all non-local workers hired for the contract (U.S. and foreign). These costs include inbound and outbound transportation, meals and any overnight lodging while in transit. Foreign workers must also be reimbursed for all visa costs in the first workweek. másH2A provides detailed travel reimbursement guidance.

H-2B employers must demonstrate that the need for foreign workers is bona fide and temporary in nature. First-time program participants may be subject to enhanced scrutiny by the U.S. Department of Labor. másH2B’s subject matter experts will evaluate your business circumstances and prepare appropriate supporting materials to substantiate your needs.

Additional Requirements
H-2B visas are capped, meaning there is a statutory numerical limit on the total number of foreign workers who can be issued one annually. The program is limited to 66,000 visas per year, divided into two equal allotments of 33,000 for each half of the government fiscal year:
Fall visas
Fall visas become available on October 1 for workers who start employment in the first half of the fiscal year, from October 1 to March 31. Unused visas will carry over into the second half of the fiscal year.
Spring visas
Spring visas become available on April 1 for workers who start work in the second half of the fiscal year, from April 1 to September 30. Unused H-2B visas from this second fiscal period will not carry over.

With few exceptions, most eligible job categories require a bachelor’s degree or equivalent. It is often regarded as a cap-less alternative to the H-1B visa program.
TN status may be obtained in-country through a petition filed with U.S. Citizenship and Immigration Services (USCIS) (i.e., changing status to TN from another nonimmigrant classification), or out-of-country through a U.S. consulate or embassy. Canadian TN applicants may also obtain their status from a port of entry (e.g. international airport).

For most employment-based Green Cards, the foreign individual must be sponsored by a U.S. employer offering full-time, year-round employment. In most cases, the sponsoring employer must obtain a Permanent Labor Certification through the U.S. Department of Labor’s PERM Program prior to filing an immigrant petition.
Immigrant visas are allocated based on country of origin and “preference category” (EB-1, EB-2, EB-3, etc.), assigned based on the nature of the job opportunity, its requirements/skill level, and the individual worker’s qualifications (education, work experience, etc.).
Green Card sponsorship is a multi-stage, multi-year process, generally taking a minimum of three (3) years. Actual processing time varies by country and preference category.
